Website Disclaimer
What this website is, what it is not, and what you should not do on the strength of it.
The short version. Everything published here is general information written for owners in a particular situation. It has not seen your accounts, your contracts or your circumstances. It is not legal, accounting, taxation, financial, credit or industrial relations advice, and it is not a substitute for advice from someone qualified and licensed to give it.
1 · About Somerset Business Advisory
1.1 Somerset Business Advisory (“Somerset”) provides business coaching, facilitation and training to owner-managed businesses in Australia, and operates this website.
1.2 Somerset Business Advisory is a registered business name. The entity currently trading under it is Jay Singh Ahluwalia, ABN 55 040 183 469, of T2A Nirimba Education Precinct, Warawara Cct, Quakers Hill NSW 2763. If that entity changes, this clause is updated.
1.3 Somerset personnel means the people who carry out Somerset’s work: its principal, and any employees, contractors, associate coaches, trainers and operational staff engaged by Somerset from time to time.
1.4 This disclaimer forms part of the Website Terms of Use and applies to everything published on this website, and to Somerset’s articles, webinars, workshops and other general material wherever it appears.
2 · General information only
2.1 The material on this site is written for a general audience of business owners. It cannot account for your circumstances, and Somerset does not know what they are.
2.2 Reading this site, completing the Check, attending a webinar or receiving Somerset’s email does not create a client relationship and does not put Somerset under any duty of care to you in relation to a decision you make.
3 · Not professional advice, and not licensed
3.1 Nothing on this website is, or should be relied on as, legal, accounting, taxation, financial product, investment, credit, insurance or industrial relations advice.
3.2 Somerset does not hold an Australian Financial Services Licence, is not a registered tax agent or BAS agent, is not a legal practice, is not an Australian credit licensee, and is not a registered migration or insurance adviser. Somerset does not provide any of those services.
3.3 Somerset coaches the people who own, run or manage a business. The method is guided questioning against a framework. Where specialist advice is needed, it comes from the relevant professional in that field, and Somerset will say so.
3.4 Obtain your own advice before acting on anything here. If you act without it, that is your decision and its consequences are yours.
4 · The Five Foundations Check
4.1 The Check is a self-assessment. It scores the answers you give it and nothing else. It has not seen your accounts, met your team or set foot in your business.
4.2 Its output is an indication of where to look first — not a diagnosis, not a valuation, not an audit, and not a recommendation to do or not do anything in particular.
4.3 The bands, percentages and comparisons it produces are indicative. They are not a benchmark against any verified dataset, and no financial or operational decision should rest on them.
5 · Results
5.1 Somerset makes no guarantee of any financial or commercial outcome. Not a revenue figure, not a margin, not a cash position, not a sale price.
5.2 What a business does with a finding is decided and executed by that business. That is the design of the work, not a disclaimer bolted onto it.
6 · Case studies and testimonials
6.1 Where results, case studies or testimonials appear on this site, they describe what happened in that business, for those people, in those circumstances, and are published with that client’s consent.
6.2 They are not a prediction of what will happen in your business, and they are not represented as typical. Individual results vary with the business, the market, the people and the execution.
6.3 Any figures given are those reported by the client unless stated otherwise. Illustrative figures are labelled as such.
7 · Third-party material and links
7.1 Links to third-party websites are provided for convenience. Somerset does not control them, does not endorse them by linking, and is not responsible for their content, their products or their handling of your information.
7.2 Some concepts Somerset draws on are established practice and are not claimed as original. Third-party instruments and models are used under the terms of the relevant licence and remain the property of their owners.
8 · Accuracy and currency
8.1 Somerset takes care that what it publishes is accurate at the time of publication. Law, tax settings, thresholds and market conditions change, and material on this site may become out of date without being marked as such.
8.2 Somerset does not warrant that the material here is complete, current or fit for any particular purpose, and is not obliged to update it.
9 · Liability
9.1 — your rights under the Australian Consumer Law are not affected. Nothing in this disclaimer excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded.
9.2 Subject to 9.1, Somerset and Somerset personnel are not liable for any loss, cost or damage arising from your use of, or reliance on, anything published on this website. Clause 9 of the Website Terms of Use sets out how liability is limited.
10 · Governing law
This disclaimer is governed by the laws of New South Wales, Australia.
